Florida Prenup Questions
Does Florida require each person to have a lawyer for a prenup?
Florida’s premarital-agreement statute does not require separate lawyers. However, one lawyer cannot advise both parties. Independent counsel gives the person reviewing a proposed agreement advice about its terms, disclosure, and possible revisions.
How long before the wedding should we start?
Florida law sets no fixed number of days. The agreement must be signed before marriage. Starting early allows time for financial disclosure, independent advice, and negotiation; compressed timing may become relevant to a later voluntariness, duress, or coercion claim under § 61.079(7).
Can a Florida prenup protect a business or inheritance?
A prenup may define rights and obligations in property and address disposition upon separation, divorce, or death. The result depends on the agreement’s language, financial disclosure, and the surrounding circumstances. See our guides for business owners and inheritances.
What can make a Florida prenup unenforceable?
Under § 61.079(7), a party may challenge an agreement based on involuntary execution; fraud, duress, coercion, or overreaching; or unconscionability together with the statute’s disclosure and knowledge conditions. The facts and evidence matter.
